Selling a Property

If you have decided to sell your home or investment property, we can assist you with your sale, beginning with preparing the contract to provide to your selling agent. This will allow your agent to begin marketing your property. We will negotiate any contract amendment requests and oversee the exchange of contracts.  After exchange, we will liaise with your bank, Land Registry Services, and Council to prepare for settlement. We will arrange for levies and rates over the property to be paid at settlement and attend to the settlement on your behalf.

Buying a property

Buying a property is both an exciting and daunting decision. We will handle the legal aspects of your purchase, beginning with the contract review and negotiation. After contracts are exchanged, we will conduct necessary searches, liaise with your lender in relation to the availability of your loan funds at settlement, and assist you to complete and lodge an application with Revenue NSW for assessment of the transfer (stamp) duty payable on your purchase. Finally, we will attend to the electronic settlement on your behalf, including arranging any necessary adjustments so that you only pay rates and levies for the period in which you own the property, and ensuring the property title is transferred to you.

Contract Review

Buying a property is likely to be the biggest financial decision you will make in your life. It is imperative that you have the contract reviewed prior to signing, so you are aware of your obligations under the contract, and to allow for negotiation of specific terms you may require. Our fixed conveyancing fee includes the contract review for a successful purchase. If you instructed us to review a contract, and you are not the successful purchaser, or choose not to proceed, you will not incur any legal fees for your first contract review.

Property Transfers

Occasionally, a party may wish to transfer their ownership, or partial ownership, of a property to a family member, spouse or third party. This could be as a result of an agreement reached between parties or as a requirement of Court Orders. The conveyancing process in these transactions is similar to that of a purchase or sale, but does not usually require an agent or marketing campaign. Depending on the circumstances, there may be an opportunity to apply for the transfer to be exempt from incurring a stamp duty liability.
